These terms of service apply to the use of NestingPro, offered by Sounds Clear. By creating an account or using NestingPro, you agree to these terms.

1. About Sounds Clear

NestingPro is offered by Sounds Clear. Under these terms, you, as a user, are contracting with Sounds Clear.

2. Acceptance of the terms

By signing up, logging in or using NestingPro, you accept these terms. If you do not agree, you may not use the service.

3. Description of the service

NestingPro is an online tool for sheet optimization, quotes and DXF export. You can manage projects, parts, materials and customers, and export your results to CNC files.

4. Account and security

You are responsible for keeping your login credentials secure and for all activity under your account. Do not share your password with others. Report suspicious activity to us immediately.

5. Permitted and prohibited use

You may use NestingPro for legitimate workshop and production purposes. It is not permitted to use the service for:

  • Illegal activities or violation of applicable law.
  • Fraud, spam, phishing or misleading practices.
  • Infringement of the intellectual property rights of others.
  • Distribution of malware, viruses or other harmful code.
  • Circumvention of security measures or technical limits.
  • Scraping, hacking or excessive automation of the service without permission.

6. Intellectual property

Sounds Clear retains all rights to NestingPro, including software, design, trademarks and documentation. We grant you a limited, non-exclusive and non-transferable license to use NestingPro within your subscription. You retain all rights to your own designs, projects and customer data.

7. Payments and subscriptions

Certain features require a paid subscription. Our order and payment processing is handled by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles customer service inquiries, refunds and returns. 8. Service level

We strive to keep NestingPro available 24 hours a day, but we do not guarantee uninterrupted or error-free operation. Planned maintenance may cause temporary downtime.

9. Suspension and termination

Sounds Clear may suspend or terminate your access to NestingPro in case of: a material breach of these terms, non-payment, fraud or a security risk, or repeated or serious violations of our policy. You can delete your account at any time via the settings.

10. Limitation of liability

NestingPro is provided as is, without warranties that may not be excluded by law. Sounds Clear is not liable for indirect damages, such as lost profits, data loss or missed opportunities, except in cases of intent or gross negligence by Sounds Clear.

11. Governing law

These terms are governed by the law of the jurisdiction where Sounds Clear is established. Disputes will first be resolved in an amicable manner.

12. Changes

Sounds Clear may update these terms. We will actively inform you of important changes. By continuing to use NestingPro after a change, you accept the new terms.
